These terms constitute a legally binding agreement between you and Opieqmvfq C.A., a commercial company duly incorporated under the laws of the Bolivarian Republic of Venezuela, registered under RIF J-50192847-3.
2. Nature of the Service
Opieqmvfq operates a digital real estate crowdlending platform that acts as an intermediary between investors and real estate project developers in Venezuela. Our services include detailed presentation of real estate projects for collective investment, technological facilitation of the investment process, transparent tracking and reporting of funded project progress, and coordination of return distribution to participating investors. The Company acts exclusively as a technological and financial intermediary. We do not guarantee specific returns, successful project completion, nor do we assume direct responsibility for users' investment decisions.
3. Eligibility Requirements
To use Opieqmvfq services, you must meet the following requirements: be at least eighteen (18) years of age under Venezuelan law, possess full legal capacity to enter into binding contractual agreements, provide valid and verifiable identification documentation (current Venezuelan national ID card or passport), and not be subject to sanctions, legal restrictions, or court orders preventing you from participating in investment activities. The Company reserves the right to request additional documentation at any time to verify user identity and eligibility.
4. Investment Risks
All investment activity carries inherent risks that you must understand and accept before committing capital. By using our platform, you expressly acknowledge that real estate investments may lose value due to market fluctuations, that historical returns presented do not constitute a guarantee of future results, that construction projects are subject to delays, cost increases, or cancellation due to force majeure, that macroeconomic, political, exchange rate, and regulatory factors specific to Venezuela may significantly impact investment values, and that the liquidity of real estate assets is inherently limited. We strongly encourage you to consult with a qualified and independent financial advisor before making any investment decision.
5. Intellectual Property
All content available on Opieqmvfq.com, including without limitation text, graphic designs, logos, trademarks, icons, photographs, data compilations, source code, and software, is the exclusive property of Opieqmvfq C.A. or its respective licensors, and is protected by Venezuelan and international intellectual property, copyright, and trademark laws. The reproduction, distribution, modification, transmission, public display, creation of derivative works, or any form of exploitation of the content without prior express written authorization from the Company is strictly prohibited.
6. Limitation of Liability
To the maximum extent permitted by Venezuelan law, Opieqmvfq C.A. shall not be liable for indirect, incidental, special, consequential, punitive, or exemplary damages, nor for lost profits, data loss, or business interruption resulting directly or indirectly from the use or inability to use the platform or its services. The Company's total cumulative liability to the user shall not, in any event, exceed the total amount of fees actually paid by the user during the twelve months preceding the event giving rise to the claim.
7. Applicable Law and Jurisdiction
These Terms and Conditions are governed by and construed exclusively in accordance with the substantive and procedural laws of the Bolivarian Republic of Venezuela. For the resolution of any dispute arising from or related to these terms, the parties irrevocably submit to the jurisdiction of the competent courts of the city of Caracas, Capital District, Venezuela, expressly waiving any other jurisdiction that may correspond to them. If any provision of these terms is declared null, invalid, or unenforceable by a competent judicial authority, the remaining provisions shall remain in full force and effect.
8. Amendments and Validity
Opieqmvfq C.A. reserves the right to modify, update, or replace these Terms and Conditions at any time and at its sole discretion. Modifications shall take effect upon publication on the website. Continued use of the platform after publication of updated terms shall be deemed tacit acceptance thereof. We will notify you of substantial changes via email or prominent notice on the platform.
